TERMS OF SERVICE

Definitions

For the purposes of these Terms and Conditions:

Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

Country refers to: United States.

Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Anna Cameraon Llewellyn or Cameraon Creative LLC, South Carolina.

Client(s) (referred to as either “Client(s)” or “You” in this Agreement) means the individual accessing or using Cameron Creative, or the company, or other legal entity on behalf of which such individual is accessing or using Cameraon Creative, as applicable.

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Service refers to all Design, Development, Videography, Photography, Coaching, and any additional ongoing services provided by Cameraon Creative.

Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between Client and the Company regarding the use of Cameraon Creative.

Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by Cameron Creative.

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between Client and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Services provided.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You can contact ANNA@CAMERAONCREATIVE.COM for more information.

Your access to and use of Cameraon Creative is also conditioned on Client’s acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes the policies and procedures on the collection, use and disclosure of Client’s personal information when using CAMERAONCREATIVE.COM and tells Client about Client privacy rights and how the law protects the Client. Please read Our Privacy Policy carefully before using Cameraon Creative.

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Cameraon Creative shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You to the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Legal Compliance.

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Branding, Web Design, Development, Marketing

Estimates & Contracts
Estimates provided to prospects will be honored for 30 days. A new quote will then be provided upon request. Contracts that have been written, but not signed by the Client will only be accepted within 30 days of the delivery date. A new contract may be drawn up upon request.

Charges & Fees
All new web design projects require an initial 50% deposit that will be due at contract signing. The remaining 50% balance will be due upon acceptance of the completed web development project before it is released to the Client.

Any check payments that do not clear will be charged a $35 fee. Cameraon Creative retains the right to hold all graphics and project development with the exception of content and graphics provided by the Client, until payment is received for such items (see copyright & ownership clause).

Payments
Cameraon Creative accepts payments via Cash, Check, and Zelle. Your project will not be released to you or uploaded until full payment is received.

Web Site Design Credit
Cameraon Creative custom web design Clients will host a Cameraon Creative logo and link on their website footer.

Copyright & Ownership
Upon completion of the project, Anna Cameron Llewellyn transfers all rights and ownership of designs for the project by Cameraon Creative to the Client. Software and third party graphics or programs are not transferred to the Client and remain under copyright of their respective owners. Cameraon Creative reserves the right to display websites and graphics that have been designed for their website, and in any marketing material to aid as examples of our work.

Refunds
Cameraon Creative requires a deposit before we begin work on any web project. A request to terminate services must be presented to Cameraon Creative in writing. No refunds on work already completed. If after paying the deposit the Client no longer wishes to continue, and work on the site has not begun, the Client can opt out of the next payment. Cameraon Creative does not have the power to offer refunds on hosting and domain services purchased by the Client. If you are dissatisfied with the hosting services provided, we will be happy to work out a solution with you that will meet your company needs. Cameraon Creative will not negotiate chargebacks with any person or company. Our Refund policies are clearly stated above, and all Clients are asked to read and agree to our terms of service prior to the start of any project. Additionally, if we are unable to communicate with a Client on a project for a duration of at least forty-five days (45) by phone or email during the design and development process, the project will be canceled without prior notice and no refund will be issued.

Liability
Services purchased from Cameraon Creative are provided “as is” without warranty of any kind that the web design project will be uninterrupted or error free. In no event shall Cameraon Creative be liable to the Client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of the website, services, and/ore goods provided to the Client. This includes, without limitation, lost profits, business interruption, loss of data or other losses directly resulting from the use of the website, services, and/or goods provided to the Client. The entire risk as to the quality and performance of the web design is with the Client.

Acceptance
Please note that by submitting your Initial Deposit or downpayment for our services you are agreeing to all of our terms of service as written here. Cameraon Creative reserves the right to change or update these terms at any time without prior notice.

Ongoing Support & Internet Marketing Services
Are subject to the above terms and are paid on a yearly, monthly or hourly basis depending on the agreement details as stated in the original estimate(s).

Videography & Photography

For the purposes of these Terms and Conditions:

Event refers to the photography/video shoot itself.

Model refers to any human or animal photography subject to be used during the shoot.

Digital(s) refers to the completed image/video files to be delivered to the Client.

Images & Copyrights

The photographs/video produced by Cameraon Creative once delivered to the Client may be altered and used by the Client in any way. Please credit Cameraon Creative for any personal use and social media posts made. Client does not have the right to use the delivered digitals for profit or in any commercial, advertising, or third party publication.

Model Release

The Client and Models hereby grant to Cameraon Creative and its legal representatives and assigns, the irrevocable and unrestricted right to use, publish, and alter photographs of the Client and Models for marketing, editorial, trade, advertising and any other purpose and in any manner and medium.

Limit of Liability

In the unlikely event that Anna Cameron Llewellyn of Cameraon Creative is injured, becomes ill, or has an emergency that prevents them from attending the planned brand photography/video date, Cameraon Creative will make every effort to immediately reschedule with the Client. If a new agreed upon date cannot be reached with the Client in the event of Anna Cameraon Llewellyn’s injury, illness, or emergency, Cameraon Creative will return any payments received for the booked session.

In the unlikely event that photographs or video has been lost, stolen, or destroyed for reasons within or beyond Cameraon Creative’s control, Cameron Creative’s liability is limited to the return of half of the payments received for the booked session.

Retainer & Payment Schedule

50% of the total cost is due at initial invoice receipt as a retainer. This is non-refundable except in exceptional circumstances (see Limit of Liability above). In the event of Client cancellation, the paid retainer is non-refundable. The retainer shall applied towards the total cost of the service to be rendered. The remaining charges are payable in full on the date of the session. No photography/video will take place and no rights are granted until payment is made in full.

Event Changes

Cameraon Creative must be notified of any changes in the date, time or location of the event or any other changes affecting the services to be provided under this Contract.  Upon notice of any changes in the date, time or location of the event (including, without limitation, Client’s cancellation of the event), it shall be within Cameraon Creative’s sole discretion to either deem the change to be a cancellation of this Contract by Client and collect payment for all services rendered and expenses incurred prior to and including the date of cancellation plus the Cancellation Fee as provided herein; or accommodate the changed time, date or location, at the rate in effect at the time of the change. If there is an agreed-upon change to the location, Client agrees to pay any additional travel and expense costs associated with the changed location.

Production

Client grants Cameraon Creative and its affiliates full production and editorial control regarding all aspects of production. Cameron Creative makes no guarantee either expressed or implied in regard to aesthetic qualities of the products and services offered.  Cameraon Creative makes no guarantee concerning any particular effect, request, specific pose, photograph or videotaped segments.  Cameraon Creative warrants that all album and video products (to the extent included in Client’s package) shall be free from material defects in materials or workmanship for a period of one year, excluding normal wear and tear, cosmetic aging and damage caused by mishandling or improper storage. 

Delivered Photography & Video

Cameraon Creative shall have sole discretion as to the recording and inclusion of any portions of the event in the final edited digital copy of Client’s video or photography, which will be delivered to Client through a digital download, and shall have no liability or reduction in fees for the failure to record or include any portion of the event.  Images and video are edited at Cameraon Creative’s discretion, and delivered proofs may not include all images shot. Cameraon Creative reserves the creative right to edit and release only those deemed creditable as professional in quality and within Cameraon Creative’s artistic standards.  Every effort will be made to assure satisfaction according to Cameraon Creative’s professional standards.  Cameraon Creative is not responsible for Client’s or any third party’s subjective interpretations or opinions of the photography or videography. 

Permits/Licenses

Client is responsible for determining whether any permits or licenses are required for any location or venue where photography and/or videographer services will be performed. Client is also responsible for payment of any fees and costs associated with such permits or licenses. Client agrees to obtain all necessary permits and licenses before the event date. The photographers and videographers (if included in Client’s package) are limited by the guidelines of the event space. Among other restrictions, Cameraon Creative and its third party servicers and contractors are not responsible for lighting restrictions imposed at any event space, whether known or unknown by Client prior to the event day. Client agrees to accept the technical results of their imposition on the photographer and videographer.

Environmental  

Client is aware that restrictions imposed by the event space or any guests and the constraints of the physical environment can affect the quality and extent of photography and videography coverage possible. Cameraon Creative’s failure to perform any term or condition of this Contract as a result of conditions beyond its control such as, but not limited to, restrictions imposed by others, the lateness of the Models/Subjects, schedule complications, traffic, rendering of decorations or props, restrictions of the event space, constraints of the physical environment, war, strikes, fires, floods, acts of God, governmental restrictions, power failures, or damage or destruction of any network facilities or servers, shall not be deemed a breach of this Contract or relieve Client of its obligation to make full payment under this Contract.  Cameraon Creative cannot guarantee coverage of outside events during inclement weather.  Client is responsible for obtaining all permissions and clearances, etc., and adequate shelter from inclement weather and extreme temperatures as required by Cameraon Creative to perform this Contract. Cameraon Creative shall not be held responsible for damage to products or wardrobe during environmental events or portraiture. Client is responsible to arrange personal assistance for products or wardrobe during the event.

Usage

After event, Client, individually and as agent for all members of the party and guests, hereby grants to Cameraon Creative and its affiliates all rights for display, airing, exhibition, promotion, newsletter, contests, and advertising use of all photos and video produced including the images, likenesses and voices, and, on behalf of their legal representatives, heirs and assigns, hereby release(s) Cameraon Creative and its affiliates, legal representatives, employees and assigns from all claims and liabilities relating to use of said photos or video (and, without limitation, the images, likenesses and voices contained therein). Client waives any right to inspect or approve the photographs or video or the use to which it may be applied, including any written copy that may appear in connection therewith. 

Delivery of Digitals

Normal delivery of Client’s digitals is 4 to 6 weeks after the event. This delivery schedule is only approximate, and depends on various factors, including Client’s provision of production materials for inclusion. Cameraon Creative makes no guarantee of any delivery date and reserves the right, within its sole discretion to extend the delivery schedule, as necessary for proper completion of the event digitals, if applicable, without any reduction in fees or other obligations of Client hereunder.

In Event of Client’s Loss/Destruction of Digitals

Cameraon Creative and its affiliates shall assume no responsibility for loss or destruction of the images or video footage when they are out of Cameraon Creative’s possession. Cameraon Creative recommends that Client back-up the images and video footage and recommends that Client make multiple copies to store in separate devices such as a hard drive or cloud-based storage location. Cameraon Creative and its affiliates shall not be held responsible for the failure of digital downloads due to mishandling.

Travel

Client is responsible for all travel expenses incurred by Cameraon Creative or its affiliates or third party contractors in connection with the photography and/or videography services. Specifically, Client shall reimburse Cameraon Creative for the following expenses incurred or to be incurred by each photographer and/or each videographer: any tolls, gas, parking (for each parking fee incurred in connection with the event), taxi and other transportation costs (such as Uber or Lyft), and any long distance and overnight accommodation fees referred to below. Any travel costs payable by Client shall be paid to Cameraon Creative no later than fifteen (15) days after the date of invoice.

If the event location is beyond Cameraon Creative’s Service Area (the Charleston Metropolitan area of Charleston, Dorchester, or Berkeley County), an additional travel fee of $50.00/60 miles will be added to the invoice.

Client also agrees to pay a talent overnight accommodation charge (the “Accommodation Fee”) if the event location is 2 or more hours away from Cameraon Creative’s “Base” (2820 Bacons Bridge Rd, Summerville, SC 29485) as determined by Cameraon Creative using mapping technology which takes into account, without limitation, traffic patterns, ferry crossing, and road conditions, as applicable. The Accommodation Fee is applied to the costs of overnight accommodations for each shooter. If the wedding location is more than 2 hours but less than 3 hours away from the Base, Client agrees to pay an Accommodation Fee for one night for each shooter. If the event location is more than 3 or more hours away from the Base, Client agrees to pay an Accommodation Fee for two nights for each shooter covering the evening before and the evening of the event.

Meals 

If the event exceeds more than 5 hours, the photographer(s) and videographer(s) and/or staff, will take a one hour break up to one (1) hour for either lunch or dinner, the timing being at their sole discretion and with no reduction in fees. The time spent by the photographer(s), videographer(s), and staff for meals does not pause or extend the total consecutive hours included in Client’s package. The one hour spent for lunch and/or dinner will count towards the total consecutive hours included in Client’s package. Cameraon Creative is not responsible for any photography and/or videography coverage missed during such times.  

Event Scheduling

It shall be the responsibility of Client to contact Cameraon Creative to schedule a mutually agreeable event time, at least three weeks’ prior to the proposed date. Cancellation or rescheduling of an on-location event within 5 days of the scheduled date will result in the loss of the on-location event. On-location events must include an alternative site to accommodate inclement weather. Inclement weather is not a legitimate reason for the cancellation of an on-location event.

Coaching

Cameraon Creative runs private sessions/workshops. These do not qualify as a job interview, audition, or representation opportunity in any way. The presence of any teacher, casting director/associate, agent or manager is neither a guarantee nor a promise of employment or representation. It is NOT an audition nor employment/representation opportunity. The intent of the class/workshop/showcase is solely educational, a learning and networking experience.

Payments
Cameraon Creative accepts payments via Cash, Check, and Zelle for coaching within 24 hours of a completed session.

Cancellations & Refunds

Cameraon Creative coaching sessions operate on a strict cancellations and refunds policy:

  1. Cameraon Creative reserves the right to cancel any session at any time.

  2. A minimum of 24hours cancellation policy for each coaching session.

  3. We will not process a refund if you have paid in advance for a session or workshop and cancel within less than 24 hours, do not show up for your session within 15 minutes after your start time without an email or phone call, or if you do not complete all workshop sessions.

Consent for Photography, Film, and Audio Recordings

In addition to the capture and use of your likeness during class for your own personal and audition use, you consent to the capture of still images (photographs), moving images (film/video), and audio recordings of you during sessions for Cameraon Creative’s marketing.

You accept that the subsequent images and recordings may be in a number of media for Cameraon Creative, including but not limited to print, digital and electronic and may be used by Cameraon Creative and/or by agents authorized by the studio for educational, promotional, advertising and/or marketing purposes in appropriate file formats via web-based and/or other digital and/or print methods. You understand that (1) editing may be required by the Film Actors Studio Charlotte or by agents authorized by the Studio for quality or technical purposes; (2) edited subsections may be used in other Studio materials for purposes stated above; (3) the image(s) and/or recording(s) will be stored securely in appropriate file formats on reputable servers and held in accounts belonging to the Studio and/or its authorized agents.

CODE OF CONDUCT

Drugs & Alcohol

Illegal drugs are forbidden at Cameraon Creative. The consumption of illegal drugs and alcohol is forbidden during class exercises. Being under the influence of drink or drugs during class hours will not be tolerated under any circumstances and may result in the student’s immediate dismissal. Cameraon Creative has a non-smoking policy, therefore no smoking is allowed in and around any part of the studio. Vaping and e-cigarettes are also not permitted.

Behavior Expectations

Cameraon Creative expects all coached persons to conduct themselves at all times in an orderly manner, respecting the rights, privacy and property of others. Due to the nature of the class work, which may include discussion of age appropriate themes, use of adult language, and the use of age appropriate materials and props, students will be required to demonstrate high levels of maturity whilst participating in their sessions.

Respect

Students agree to abstain from the following prohibited actions and/or behaviors:

  1. To solicit others to perform or participate in any unlawful acts;

  2. To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;

  3. To infringe upon or violate our intellectual property rights or the intellectual property rights of others;

  4. To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

PRIVACY POLICY

Your privacy is very important to us. This Privacy Policy explains how Cameraon Creative may:

  • Collect, use, and disclose information we obtain. All other terms not defined herein will have the meanings set forth in the Terms.

“Personal Information” means information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, address, email address, or phone number. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.

We’ve updated our Privacy Policy and improved our privacy practices so we can better safeguard your data. By continuing to use our Site, you accept the terms of this Privacy Policy and our Terms of Use.

Cameraon Creative collects Personal Information when you communicate with us.

We also collect information, such as anonymous usage statistics, by using cookies, server logs, and other similar technology as you use the Service. As our services evolve, we may from time to time amend this Privacy Policy. We encourage you to check our Site frequently to review the current Privacy Policy in effect and any changes that may have been made to it.

Cookies, Automatic Data Collection, and Related Technologies. The Service collects and stores information that is generated automatically as you use it, including your preferences and anonymous usage statistics.

When you visit the Service, we and our third-party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology. Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Service may not work properly.

By using the Service, you are authorizing us to gather, parse, and retain data related to the provision of the Service and via Third Party Websites.

How Cameraon Creative Uses Client Information

  • To improve our spread of information and communicate with you.

  • Internal and Service-Related Usage. We use information, including Personal Information, for internal and service-related purposes only and may provide it to third parties to allow us to facilitate the Service. We may use and retain any data we collect to provide and improve our services.

  • Communications. We may send email to the email address you provide to us to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance.

  • Marketing. We may use information, including Personal Information, to provide online advertising on the Service and to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you.

  • Aggregate Data. We may anonymize and aggregate data collected through the Service and use it for any purpose.

Cameraon Creative may Disclose/Share Client’s Information:

  • With our third-party service providers

  • To protect and defend our rights and property

  • With your permission.

We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.

We Use Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of the Service.

Social Networking and Other Websites. The Extension may allow you to share information, with social networking websites, such as Facebook. We do not share your Personal Information with them unless you direct the Service to share it. Their use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings on their websites.

Search Engines. Personal Information, such as your name, if you select your name as your username, may also be accessible via search engines or similar services.

Marketing. We may allow access to aggregated and/or anonymized data collected by the Service to enable the delivery of online advertising on this website, or otherwise facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; or protect yours’, ours’ or others’ rights, property, or safety.
